Casual Employment Contract

This Casual Employment Contract can be used for all* casual employees engaged in Australia.  A person is a casual employee if they accept an offer for a job from an employer knowing that there is no firm advance commitment to ongoing work with an agreed pattern of work. The employee works on a ‘casual’ basis and working hours can change with short notice. 

The Contract is comprehensive in nature and includes all necessary detail to provide the framework for a casual employment relationship including commencement dates, location of employment, ordinary hours of work, payment (and compensation for all legal entitlements), casual loadings (compensation for permanent employment entitlements such as annual leave), superannuation, job title/position and reporting lines, leave (as per Fair Work Act 2009 (Cth)), confidential information, policies and procedures and notice/termination. 

*Note. This contract is not suitable for non-constitutional corporation employers in Western Australia; State public sector employers (except in Victoria); and local government employers (except in Tasmania and Victoria).
